Any content uploaded by a YourSpin user using the song parts of an artists will remain the property of the artist and the label.

YourSpin will not sell or sublicense any users content.

If any other media outlet or the label wishes to use the YourSpin content they must contact the YourSpin user via YourSpin and Spin1038.com

YourSpin will only use the content on the YourSpin and Spin1038.com site and apps.

The user is responsible for any content uploaded, this includes any unauthorised samples from other artists or movies.

We do not endorse YourSpin users using 3rd party content without prior permission from that content producer.

If we have users who continuously use other's content without permission, the user account may be suspended or profile deleted.

YourSpin retains the right to modify or delete any content that is deemed offensive or otherwise.

YourSpin does not verify that samples are cleared or any entries or claims uploaded to the YourSpin site are accurate.

With regards privacy please see our privacy policy, in a nutshell we need to keep cookies on our visits to track login etc. When you click on ads sometimes cookies are implemented also to see if you sign up for that advertisers campaign etc. This is standard practice.

These Terms of Service ("Terms") govern your access to and use of the YourSpin and Spin1038.com websites and mobile applications (the "Services"), and any information, text, illustrations, files, images, software, scripts, graphics, photos, sounds, music, videos, content, materials, products, services, technology, documentation, and interactive features, or other materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content"). Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.

BASIC TERMS

You are responsible for your use of the Services, for any content you post to and download from the Services, and for any consequences thereof. You agree to defend, indemnify and hold harmless YourSpin, its affiliates, connected companies and their respective directors, officers, employees and agents from and against all claims and expenses including legal costs arising out of the use of YourSpin by you or your account.

ACCOUNT SECURITY

You will receive a password after completing the registration process. You agree to maintain the confidentiality of your password and account, and that you are fully responsible for all activities that occur under your password or account. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security, and to exit from your account at the end of each session. We will not be liable for any loss or damage arising from your failure to comply with these conditions. If for any reason your account is terminated by either you or us, all of your Points accrued will be forfeited. If your account is compromised we will not be held responsible.

CONTENT ON THE SERVICES

While YourSpin makes no claim to the content uploaded to YourSpin if it contains sampled content from an artist, label or third party it remains the content of that artist, label or third party. The only place YourSpin content will be published is on YourSpin and Spin 1038, Soundcloud and the promoter's (artist label or other) website or digital properties "Services" (applications, website etc.).

All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated this Content. We may monitor and control the content posted via YourSpin be it by the app or online. We may remove it if deemed offensive or defamatory.

VERIFICATION

We do not verify, endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted by users via the Services. We do not verify if users are using licensed content or illegally sampled elements. We do not endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will YourSpin be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, any offensive language or content or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.

YOUR RIGHTS

By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license to use such Content on the YourSpin or Spin1038,com and YourSpin partner sites and services only. YourSpin can do this in any and all media or distribution methods (now known or later developed). We may delete or edit any content we feel is deemed inappropriate. 

This license is authorising us to make your posts available to the rest of the world and to let others do the same. In other words people may share a link to your content. If others intend to use your content they must contact the content producer for permissions. YourSpin will be unable to track if this is done illegally, but will report it to the content producer if it is.

YourSpin gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software that is provided to you by YourSpin as part of the Services. Our goal is to provide a service that allows the community to discover and receive content from sources that interest you the community as well as to share community content with others. We respect the ownership of the content that users share and each user is responsible for the content he or she provides. Because of these principles, we do not actively monitor or verify community content and will not censor user content, except in limited circumstances described below.

CONTENT RULES

You shall not submit any User Content protected by copyright, trademark, patent, trade secret, moral right, or other intellectual property or proprietary right without the express permission of the owner of the respective right. You are solely liable for any damage resulting from your failure to obtain such permission or from any other harm resulting from User Content that you submit..In order to provide the YourSpin service and the ability to communicate and stay connected with others, there are some limitations on the type of content that can be published with YourSpin. These limitations comply with legal requirements and make YourSpin a better experience for all. We may need to change these rules from time to time and reserve the right to do so. Users cannot use content from other sources unless permission has been sought from the content provider.

Trademark: We reserve the right to reclaim user names on behalf of businesses or individuals that hold legal claim or trademark on those user names. Accounts using business names and/or logos to mislead others will be permanently suspended.

Impersonation: You may not impersonate others through the YourSpin service in a manner that does or is intended to mislead, confuse, or deceive others.

Privacy: You may not publish or post other people's private and confidential information, such as phone number, email address, credit card numbers, street address or PPS numbers, without their express authorization and permission.

Violence and Threats: You may not publish or post direct, specific threats of violence against others, users who do will receive a warning and in extreme cases have their accounts deleted.

Copyright: We will respond to clear and complete notices of alleged copyright infringement. Our copyright procedures are set forth in the Terms of Service.

Unlawful Use: You may not use our service for any unlawful purposes or for promotion of illegal activities. International users agree to comply with all local laws regarding online conduct and acceptable content.

By submitting User Content, you also grant us the right, but not the obligation to use your biographical information including, without limitation, your name and geographical location in connection with broadcast, print, online, or other use or publication of your User Content. You waive any and all claims you may now or later have in any jurisdiction to so-called “moral rights” or rights of “droit moral” with respect to the User Content.

We reserve the right to display advertisements in connection with your User Content and to use your User Content for advertising and promotional purposes. You acknowledge and agree that your User Content may be included on the websites and advertising networks of our distribution partners and third-party service providers.

We have the right, but not the obligation, to monitor User Content. We have the right in our sole discretion and for any reason whatsoever to edit, refuse to post, remove, or disable access to any User Content.

SPAM AND ABUSE

YourSpin strives to protect its users from spam and abuse. Technical abuse and user abuse is not tolerated on YourSpin, and will result in permanent suspension. Any accounts engaging in the activities specified below are subject to permanent suspension.

Serial Accounts: You may not create serial accounts for disruptive or abusive purposes, or with overlapping use cases. Mass account creation may result in suspension of all related accounts. Please note that any violation of the YourSpin Rules is cause for permanent suspension of all accounts.

Malware/Phishing: You may not publish or link to malicious content intended to damage or disrupt another user's browser or computer or to compromise a user's privacy.

For the sake of quality content please refrain from using YourSpin as an advertisement portal.

You represent, warrant, and confirm that you will not submit any User Content that:

 Violates or infringes in any way upon the rights of others, including, but not limited to, any copyright, trademark, patent, trade secret, moral right, or other intellectual property or proprietary right of any person or entity;

Affects us adversely or reflect negatively on us, the Website, our goodwill, name or reputation or cause duress, distress or discomfort to us or anyone else, or discourages any person, firm or enterprise from using all or any portion, features or functions of the Website, or from advertising, linking or becoming a supplier to us in connection with the Website;

Impersonates another or is unlawful, threatening, abusive, libelous, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, pornographic, or otherwise objectionable;

Encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law

Is an advertisement for goods or services or a solicitation of funds

Includes personal information such as messages which identify phone numbers, social security numbers, account numbers, addresses, or employer references;

Contains a formula, instruction, or advice that could cause harm or injury; or results in the transmission of junk e-mail, chain letters, duplicative or unsolicited messages, or so-called “spamming” and “phishing.”

ACCOUNT

Your account may be suspended for Terms of Service violations if any of the above is true. Accounts created to replace suspended accounts will be permanently suspended.

Accounts engaging in any restrictive behaviours may be investigated for abuse. Accounts under investigation may be removed from Search for quality. YourSpin reserves the right to immediately terminate your account without further notice in the event that, in its judgment, you violate these Rules or the Terms of Service.

COPYRIGHT POLICY

YourSpin respects the intellectual property rights of others and YourSpin users and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.
